Does their ownership structure make sense? Should they sell or should they= hold? And what will the impacts look like for commercial property markets= ? We=E2=80=99ve taken a look at what the Budget means for commercial propert= y investors. Goalposts shift on capital gains Since 1999=2C investors who held an asset for more than 12 months have onl= y had 50% of their capital gain added to their taxable income in the finan= cial year the asset was sold. Investors who purchased assets before 7.30pm on Budget night will retain g= randfathering of gains accrued under the current system up to 1 July 2027.= Capital growth generated after that date will then be assessed under a ne= w framework. From 1 July 2027=2C the Government proposes to replace the existing 50% CG= T discount for all assets held longer than 12 months with inflation-adjust= ed indexation=2C coupled with a minimum 30% tax on capital gains (https://= www.pitcher.com.au/insights/federal-budget-2026-27-a-fundamental-shift-in-= capital-gains-tax-pre-cgt-assets-indexation-and-minimum-tax/) . Investors who purchased before this date=2C but sell after=2C will have ga= ins apportioned between the current and new systems. (A valuation will be= required on June 30 2027). Effectively=2C the Budget has created a July 1 2027 deadline for investors= to sell for the full advantage of the 50% CGT discount. Beyond that point= =2C the new arrangements may encourage some owners to hold assets for long= er=2C positioning them as part of broader family succession planning. What about pre-1985 purchases? Pre-CGT era assets are those purchased before 20 September 1985 (https://w= ww.savings.com.au/news/federal-budget-2627-savers?utm_source=3Dchatgpt.com= ) and have historically been exempt from capital gains tax. Owners have b= een able to sell without paying tax on decades of capital growth. From 1 July 2027=2C the Government has effectively reset the clock=2C with= growth after this date falling under the new inflation-indexed CGT framew= ork. For example=2C a warehouse bought in 1982 and worth $4 million by Jul= y 2027 would retain exemption on gains to that point=2C but any increase i= n value after 2027 could become taxable when sold. Trusts receive a shake-up Additionally=2C from 1 July 2028=2C a new 30% minimum tax on discretionary= trusts (https://budget.gov.au/content/factsheets/download/tax-explainers-= minimum-tax-discretionary-trusts.pdf) will reduce the tax flexibility tha= t has traditionally supported many commercial property ownership structure= s. These changes will also frame discussions between investors=2C their ac= countants=2C and advisers. CRE avoids negative gearing changes Negative gearing has been grandfathered for all investors who held propert= y before Budget night. However=2C commercial property investors have sidestepped (https://budget.= gov.au/content/factsheets/download/tax-explainers-negative-gearing-capital= -gains-tax.pdf) the changes their residential counterparts now face. Inve= stors who purchase existing residential properties after Budget night can= no longer use the losses they make on the property to offset other income= =2E The Government has instead reserved negative gearing provisions to new b= uilds to stimulate construction and supply. For commercial property investors =E2=80=93 of both established and new bu= ilds =E2=80=93 nothing changes: they can continue to offset losses on thei= r commercial properties against other income. It's true that negative gearing is less common in commercial property inve= stment. Through higher rental yields=2C strong rent growth and tenant-paid= outgoings=2C commercial property assets are often positively geared. None= theless=2C from a resale perspective=2C the preservation of negative geari= ng for commercial assets could strengthen the sector=E2=80=99s appeal and= encourage some residential investors to diversify into industrial units= =2C strip retail=2C strata office or other assets. Could the changes impact the appeal of commercial in SEQ? The tax reforms could reshape investor behaviour=2C placing greater emphas= is on yield and cash flow as key drivers of investment decisions rather th= an capital growth. South East Queensland remains one of the stronger-performing markets natio= nally for commercial property yields. Brisbane leads the other capital cit= ies (https://www.realcommercial.com.au/news/proptrack-commercial-yields-re= port) in yield terms and the prospect of strong cash flow=2C longer lease= terms and ongoing negative gearing provisions may underpin interest in th= e region. Industrial properties=2C for instance=2C continue to offer reliable income= backed by long-term tenants in logistics=2C trade and manufacturing=2C wh= ich may encourage investors to prioritise stable returns over capital recy= cling.
